EPC-plicht ook als er geen enkele vorm van publiciteit wordt gemaakt

Vanaf 1 april 2022 moet, naast verkoop en verhuur, ook een EPC verplicht aanwezig zijn in de volgende gevallen:

  • bij verkoop, ook als er geen enkele vorm van publiciteit wordt gemaakt;
  • bij het vestigen van een nieuwe erfpacht;
  • bij het vestigen van een opstalrecht.

Deze verplichting geldt zowel voor residentiële als voor niet-residentiële eenheden.

Bij een verkoop zonder publiciteit moet het EPC ten laatste voor het sluiten van de onderhandse akte, of indien er geen onderhandse akte is, voor het verlijden van de authentieke akte, beschikbaar zijn.
